What investors need to know by Oct. 15

U.S. crypto tax deadline applies to extension filers

Oct. 15 is not a special deadline covering every U.S. person who owns Bitcoin, Ethereum or other digital assets. It is the extended filing date for most calendar-year individuals who timely obtained an extension for their 2025 federal income tax return.

IRS Publication 17 lists April 15, 2026 as the regular deadline for most calendar-year taxpayers and Oct. 15 as the deadline for returns covered by an automatic extension. The agency’s e-file calendar separately identifies Oct. 15 as the last date for transmitting returns on a Form 4868 extension.

Form 4868 only extends the filing date. A taxpayer who owed money for 2025 generally had to estimate the liability and pay it by April 15. Filing on Oct. 15 therefore does not erase interest or payment penalties that may have accumulated during the six-month period.

Some taxpayers can have different deadlines. IRS guidance notes that disaster relief can extend filing dates for people in qualifying areas, while special rules apply to certain U.S. citizens and residents living abroad. Investors covered by one of those provisions need to use the deadline that applies to their own return.

Form 1099-DA may not show what investors paid

The largest change for the 2025 crypto tax year is Form 1099-DA.

Treasury and the IRS require covered custodial brokers to report gross proceeds from certain digital-asset sales made from Jan. 1, 2025 onward. Brokers were required to give customers statements carrying the information reported to the IRS.

Gross proceeds are not the same as taxable profit. If an investor bought a token for $8,000 and later sold it for $10,000, the $10,000 is proceeds while the gain would generally start from the $2,000 difference before applicable adjustments.

For most 2025 transactions, brokers were not yet required to report cost basis. The IRS warned that most 2025 Forms 1099-DA would leave taxpayers responsible for calculating what they originally paid for the assets before determining gains or losses.

As previously reported, some crypto investors approaching the extension deadline were still trying to reconcile incomplete or uncertain 1099-DA information. An August survey of 1,000 U.S. crypto investors found that 21% of respondents who filed or planned to file an extension were still waiting for information from an exchange or platform.

The IRS does not make receipt of a tax form a condition for reporting a transaction. Its digital-asset FAQ states that taxpayers must report taxable income, gains and losses even when they never receive a Form 1099 or other information return.

Crypto investors must report more than cash sales

The 2025 Form 1040 asks every filer a digital-asset question and requires a “Yes” or “No” answer.

The IRS explains that a taxpayer generally answers “Yes” after receiving digital assets through mining, staking, rewards or payments, or after selling, exchanging or otherwise disposing of a digital asset. Swapping one cryptocurrency for another can count as a disposition even when no dollars enter the transaction.

Spending crypto on goods or services can trigger the same reporting requirement. Paying a transaction fee with digital assets can constitute a digital-asset transaction as well. Investors who sold assets held as capital assets generally calculate the gain or loss using Form 8949 and report the resulting totals through Schedule D.

Receiving staking, mining or certain other rewards follows an income path instead of being treated solely as a capital disposal. The IRS says digital assets received as compensation or ordinary income must be reported under the rules applicable to that type of income.

Merely owning crypto does not automatically produce a taxable transaction. Buying digital assets with U.S. dollars and holding them generally permits a “No” response to the digital-asset question when nothing else occurred. Moving assets between wallets or accounts controlled by the same taxpayer generally falls into the same category, although paying the transfer fee with digital assets can create a reportable transaction.

Current IRS crypto tax rules distinguish taxable disposals from simple purchases and holdings, with crypto-to-crypto trades, payments and asset sales generally requiring gain or loss calculations.

Missing Oct. 15 can bring separate filing penalties

Once an extension expires, a taxpayer who still has unpaid tax can face a failure-to-file penalty.

IRS guidance sets the usual failure-to-file penalty at 5% of unpaid tax for each month or part of a month the return remains late, capped at 25%. For returns required to be filed in 2026 and filed more than 60 days late, the minimum is the smaller of $525 or 100% of the unpaid tax.

A separate failure-to-pay penalty generally runs at 0.5% of unpaid tax per month, up to 25%. When both penalties apply for the same month, the IRS normally reduces the filing component so the combined monthly rate is 5%. Interest continues to accrue on unpaid federal tax and compounds daily.

Taxpayers who cannot pay the full amount are still able to file their return. The IRS provides payment-plan options, while filing by the deadline can prevent a failure-to-file charge from being added to an existing unpaid balance.

The Oct. 15 date concerns federal returns. It does not create a separate crypto-only filing process, and Form 1099-DA does not replace the taxpayer’s own records from exchanges, private wallets, decentralized platforms or earlier purchases.

New crypto rules will expand basis reporting after 2025

Broker reporting becomes more detailed for transactions made during 2026.

The IRS says mandatory basis reporting begins for certain covered transactions effected on or after Jan. 1, 2026. Digital assets bought before 2026 or transferred into a broker from another location can remain noncovered assets for reporting purposes, leaving investors responsible for records the selling broker does not possess.

The new system does not change the 2025 return now due from extension filers. As crypto.news previously reported, the first 1099-DA tax season primarily gave the IRS gross-proceeds information while leaving most investors to reconstruct their own basis.

Congress is considering separate changes to digital-asset tax rules. A recent House proposal includes provisions concerning small network fees and other crypto tax treatment, but the proposal has not replaced the rules governing 2025 federal returns. Crypto tax legislation currently moving through Congress includes a proposed $10 network-fee exemption.

The CLARITY Act addresses digital-asset market structure, not the Oct. 15 income-tax filing deadline. The Senate recorded a 49-50 vote on Sept. 15 against invoking cloture on the motion to proceed, short of the three-fifths threshold.

The stalled CLARITY Act has left federal market-structure legislation pending while regulators continue work under existing authority. The vote has not changed the IRS rules governing the 2025 tax returns due from extension filers on Oct. 15.

For 2026 transactions, mandatory basis reporting for qualifying covered digital assets will begin appearing on Form 1099-DA statements furnished during the 2027 filing season.
