An appeals court in Montenegro has withdrawn the extradition of disgraced Terra (LUNA) founder Do Kwon to the US and has ordered a new trial.
According to a new press release, an appeals court yesterday overturned the Supreme Court’s decision from late last year that ruled that Kwon should be extradited to both the US and South Korea for his alleged role in the multibillion-dollar downfall of the United States. Terra ecosystem.
In the new ruling, the appeal court judge ruled that since the old decision is ‘incomprehensible’ and lacks ‘decisive facts’, it should be withdrawn. Moreover, the first court never properly issued the extradition orders, which is a requirement.
“It was stated that the Court of First Instance did not indisputably determine the order of entry of the petitions from the Republic of South Korea and the United States of America, which is one of the criteria when making decisions under Article 26 of the above-mentioned law, in the event that the extradition of the same person is requested by different countries.”
The original ruling, made in November, claimed that legal requirements for Kwon’s extradition to the US and South Korea – where he is wanted for allegedly defrauding investors, market manipulation and mishandling funds – had been met.
As stated in the ruling at the time,
“It was determined that the legal conditions for the extradition of the citizen of the Republic of South Korea, the accused KDH (Do Kwon), had been met, upon the request of the Ministry of Justice of the Republic of Korea dated March 29, 2023…
The same decision establishes that the legal conditions for the extradition of the same suspect have been met, at the request of the Department of State of the United States of America.”
In December, authorities extended his detention period and ordered him to remain in the Balkan country for at least two more months.
Kwon was arrested in Montenegro in June 2023 after attempting to board a flight to the United Arab Emirates (UAE) using a forged Costa Rican passport.
